8月17日，市場監管總局發布《禁止網絡不正當競争行為規定》征求意見稿，面向社會公開征求意見。

According to a document published on the website of the State Administration for Market Regulation, business operators should not use data, algorithms or other technical information or means to influence users' choices, hijack traffic or disrupt the operations of website products and services provided by other business operators.

市場監管總局官網發布的文件提出，經營者不得利用數據、算法等技術手段，通過影響用戶選擇或者其他方式，實施流量劫持等行為，妨礙、破壞其他經營者合法提供的網絡産品或者服務正常運行。

Companies would also be barred from fabricating or spreading misleading information to damage the reputation of competitors and need to stop marketing practices like fake reviews and coupons or "red envelopes" - cash incentives - used to entice positive ratings.

經營者不得虛構或傳播誤導性信息損害競争對手的聲譽，不得采取虛構用戶評價，以紅包、卡券等方式誘導用戶發好評等營銷行為。

【詞彙講解】

這裡的marketing在各類商戰劇中很常見，指“activities a company undertakes to promote the buying or selling of a product or service”，即“公司為推動其産品或服務買賣而舉行的各種活動”，也就是“市場營銷”。最近很火的“直播帶貨”其實就是通過直播活動宣傳産品，進行市場營銷，可以用livestreaming marketing表示。

對于大數據殺熟行為，意見稿明确規定：

經營者不得利用數據、算法等技術手段，通過收集、分析對方的交易信息、浏覽内容及次數、交易時使用的終端設備的品牌及價值（collection and analysis of a user's transaction information, browsing history and frequency, as well as brand and value of the mobile device used to complete the transaction）等方式，對條件相同的交易向對方不合理地提供不同的交易信息（display unfair and varied information to different users for same product or service），侵害對方的知情權、選擇權、公平交易權等，擾亂市場公平交易秩序（disrupt the order of fair transactions in the market）。

交易信息包括交易曆史（transaction history）、支付意願（willingness to pay）、消費習慣（consumption habits）、個體偏好（personal preference）、支付能力（affordability）、依賴程度（dependency）、信用狀況（credit history）等。

簡單來說，“大數據殺熟”可以用big data-enabled price discrimination against existing customers表示。
